The Boy Who Cried Force Placed Insurance - Part 7 - The Birth of a Movement...

<---Previous Chapter...

September '11 - Throughout the summer of 2011, I worked with several Anons to assist in promoting activism projects worldwide. I closely followed the revolutions and riots in the Middle East, Greece, the UK, and Canada. Whatever time I wasn't spending healing from and repairing the various rapid changes in my life was spent reading books on activism and utilizing my various skillsets and contacts to assist in Anonymous Operations. Here in the US, after working on nationwide Uncut protests throughout tax season, we were all running full steam toward September's US Day of Rage.

At the time, September 17 was meant to be a day long protest in key financial locations across the US in order to call attention to the financial crisis. We didn't know exactly what we were doing at the time, but we knew we were inspiring people to take a stand. Although 2012 will be known historically as the year a ragtag group of activists, artists, and Anons changed the direction of the modern world, it was the year 2011 in which the seeds of change were planted.

Anonymous was beginning to take control of their public image. Instead of being known as a group of pranksters and practical jokers, they were beginning to be known (as they should) as a legitimate political force. It was during this time I actually started writing this blog in order to assist in the evolution.

The evolution of the US Day of Rage into the current Occupy movement as it's now known was a long road. Many people sacrificed their time, money, resources, and comfort throughout the progression of this movement. Groups worldwide have contributed in one way or another. Occupiers everywhere are brave and heroic soldiers in the class war. Their purpose of grabbing the nation's attention has succeeded. The pieces are all in place, and it's time we utilize this valuable resource to maintain balance in the court of public opinion while we do everything in our power to force the financial industry to pay penance for crimes against humanity.

Don't just Occupy Wall Street. It's time to show those in charge that we are the people. We are the majority. We are the power. The class war is far from over, but the progress we've made in the last year should give us cause to rise and fight again as the one year anniversary of Black Monday and Operation Empire State Rebellion passes. Make your voice heard. Fight the banks. Fight the system. Never give up. Above all else...

Expect Us...

Anonymous 2012

I present to you, the reader, an idea...which with your assistance can become an ideal that will verifiably change the world...

In order to participate, you must be willing to perform one simple task this year when you vote...

As you read through your ballot...every time you are voting for an office you don't understand or you can't pick between the candidates, rather than leave it blank or randomly picking people, write in a vote for Anonymous...

In doing so, you will be proactively contributing as an essential cog in a global movement designed to organically trim the fat off any Democratic government.

You see...when enough people write Anonymous for an office, there is a chance that Anonymous can actually win various elections at the city, state, federal, and worldwide level...

Don't worry...Anonymous isn't the "terrorist" group you've heard about in the mass media..."They" are not even a group at all...Anonymous is an ideal...and in voting for an ideal rather than a person, you're helping our government of, for, etc the people spotlight the broken pieces of their infrastructure. In voting Anonymous you are telling our government that quite literally you couldn't give a shit who does the job, because they all suck.

This is why I urge you instead of throwing your votes away and saying you don't care to take 10-15 extra minutes out of your time at the polls to take part in changing the world forever...

The Boy Who Cried Force Placed Insurance - Part 6 - Dem Whistleblower Blues...

ATTENTION: If you would like to donate to help my cause, please click here

I'm going to take the time here to explain to you what you go through emotionally when you're a whistleblower...because some of the things I've said and done must seem a little bit strange from the outside...

You see...when you first blow a whistle, you don't even know you've done it. Everyone hears work gossip all the time. I can sum the collective conversation behind every closed door in every office building in every country translating into every last fucking language in the history of existence...I do my job better than ____.

When you've blown a whistle, you've effectively said that to your boss and other key cogs in the machine so that you eventually find yourself repeating the story to HR, and eventually to whoever's escorting you off the premises...I hate to sound sexist at this point, but I've hired and fired a lot of people, as well as having seen it and heard firsthand accounts verified with repetition throughout several inter company grapevines. Females tend to cry at this point. I did not. I did however cry hundreds of times throughout the last year, so it's not to judge that I bring it up, merely to point out the observation.

Once you're out on your own, there's a high level of energy as you experience a wide array of emotions throughout the next month. During that time, you tell the story to everyone you can. Every time you tell the story, you start to realize how little some people are actually listening to you anymore in your own life. Then you take another step, and the backlash involves law enforcement treating you like a criminal. You have to decide then and there what to tell them...and if there's anything I can recommend whenever you're talking to anybody in life (with very few close to the heart exceptions), don't say any more than necessary.

The above video is the best 48 minutes you'll ever spend in your life. A law school professor and police officer give a speech on why you should never talk to the police. I love it. Unfortunately for me I didn't see it until after I spoke with the police. Fortunately for me, I was able to talk my way out of being arrested. The reason I disagree slightly with the "Don't talk to the police" motto is because when you're a whistleblower, fear is a common tactic used against you. It's not easy to just not say anything to the police, especially when you have been falsely accused of a terrorist act in the United States these days.

Much like its lower class cousin the Stool Pigeon (See also Snitch), the Whistleblower receives a very quick lesson when dropped off the tree, fly or die. If the bird chooses to fly in this manner, it will be free of inhibitions. This sudden freedom will make the bird fly until he's forced to the ground. At some point or another along every Whistleblower's journey, it will be forced to choose while standing on the ground whether to fight or take flight.

Although I chose to fight at every opportunity I found (leading me to eventually have to start filtering out who's worthy of my time and energy and who's not), I do not judge any whistleblower who has ever given up at any point in their journey. It's an experience few can speak from behind the shadows of. Any whistleblower can tell you that you don't just get to run to someone who's going to fix anything. That got you fired in the first place. You tell people, but they have no idea. You suddenly realize nobody gives a shit. Through the pain and the fear, you have to be intelligent enough to research  hundreds of worldwide internet searches every day of the right terms at the right times in order to find the people who understand what you're talking about.

At the same time you're doing all of this, you have to fix your financial situation. You'll spend many days on hold with various companies negotiating refinances, consolidations, lower payments, reduced costs, fill out paperwork for the D.E.S for unemployment, food stamps, etc, update your resume, conduct job searches, keep in touch with your friends and family so they're not worried you're in some kind of trouble, which you probably are because you constantly feel like you're being watched, you're constantly finding ways to feel comfortable and safe, but you don't feel safe anywhere.

You're afraid of your cell phone and internet, because you never know who's tracking you. You look underneath and around your car. You're startled by loud noises (police sirens, yelling, and crashing noises are the worst). You're constantly haunted by fear and doubt. What if you're wrong? What if they start looking into your past? Can you explain your past? Can you convince the entire world that you're a good person? Will anybody ever understand or care? Is the entire world just one giant ball of bullshit?

I bet there's not a whistleblower out there who's eyes don't begin to water just reading this...

And when it comes down to it...the war I'm waging on the banks has nothing to do with me and them anymore. I found my inner peace. I'm waging all out class warfare on financial institutions in defense of every human being in this world that has ever felt even one second of the pain I endured last year.

But don't crown me a saint just yet, because to jump ahead a bit, I really couldn't give much of a fuck about the people I'm fighting for either...

May 2011 - Many of the events from this point forward will be better documented when I get a copy of my Twitter accounts. Most of the conversations I was having were conducted over the phone, skype, and in person, not meant for public view... On the surface I was unemployed and spending most nights of the week (along with the occasional day) drinking at various dive bars around town with my friends and neighbors. I was also coming to a realization. My unemployment was being cut off soon, and I was going to have to tighten up on everything in order to afford the summer electric bills while living only on my nest egg.

Aside from everything else that was going on, I needed to take a step back and really think about everything. Fortunately I had plenty of drug connections. I was buying chron by the ounce and smoking a blunt and a few bowls a day. I picked up where I left off in my experimental days. My goal was to crack my head open and simply document everything that came out.

I would darken my room, light a candle, and practice yoga and meditation to the music that actually relaxed me...my music...hip-hop. I've been addicted to hip-hop for as long as I can even remember. I'm talking DJ Jazzy Jeff and the Fresh Prince long. I hadn't listened to a radio station in years, since I was always around musicians telling me their influences, etc, so I always have a general idea of who's who. Lupe Fiasco struck a particular chord with me. I couldn't even tell you how many times I listened to Lasers throughout the Spring...

June 2011 - Phoenix, AZ in the summer is almost unbearable some years. There are plenty of ways of to stay cool, but none of them are cheap. The government allows utility companies to adjust their costs to maximize profits from the masses based on meteorological conditions. My drug dealer never changed the price of an ounce based on how my day was, yet the electric company is allowed to charge more during the day in the summer (peak hours) and during the night in the winter in order to effectively price gouge a population already struggling through the impacts of the financial sector's abuse of the economic system.

I'm going to have to study some more before I can unfold those days...for now...

Subject: Follow Ups on Support Services Tracking

Rhonda,

Attached are some of the delays I experienced yesterday alone in reporting the volumes. I was not included in SPi’s return of their Flood Discrepancy work, was unable to access the Loan Mod tracking spreadsheet, and was not kept in the loop on how/when BAC is transitioning to the RCBAP database(s). I also attached the MOC conversation with Rose Tosier from when she assisted me in correcting the RCBAP import queries on CCS. I do not have a ticket # or anything.

Some days there are no issues in reporting/importing, and some days there are quite a few delays caused by systems, people, etc. I have had no issues in working with the departmental managers in finding solutions, although I often will have to send a 2nd or 3rd follow up (and in some cases have to just walk downstairs and talk to them in person).

In most cases, I made the decision to not cc you on these types of follow ups so as not to fill your inbox with emails that you don’t have time to sift through. I also found that I can build a better rapport coming to Peggy’s management team on my own rather than by (I can’t find a better way to phrase this) coming in with guns blazing waving the Rhonda flag. I learned in dealing with Angela and Jason that if you don’t find a way to relate to the department managers on an individual basis, it becomes very difficult to resolve any issues or discrepancies that come up.

Unfortunately, this method also leaves you without knowledge of what is going on if I am not available.

Moving forward, I’ll begin attaching email trails to my OH sheet anytime I’m spending more time than usual on a particular project (including follow ups to department managers, IT, etc) so that you have the information available when you review my OH sheet/timecard. That is the best solution I can come up with off the top of my head.

Please let me know if this will work for you for the time being. Either way, I’ll continue looking for ways to improve upon the current processes we have come up with so far without diminishing the quality of work I am able to produce.

Thanks,

Brian

"Hi Brian,

When you can, it would be very helpful to me if you could describe anything that mirrors the retaliation I've reported - presumably by the corrupt covert HBGary contractor crowd - obvious hacking / disappearence of email, phone messages, vandalism, thefts, stalk and smear, etc. I know they've told the world you'r a terrorist Big banks routinely silence their critics and adversaries, it sounds like you caught them by surprise.

Sadly there are more people like us out there that are getting clobbered badly by their retaliation machines - and you don't have to be a whistle blower to be targeted for this.
More about that soon.

It's very late, my eye lids are heavy.

Stay safe and happy!"

"That's the thing about truth...once you see it, you say "damn, this sucks." But you never want it any other way but the truth, again. LoL
Glad Anon are monitoring you. I'd assume if they have the technology, so does the #1 bank in the world....lol
Yeah, sometimes you just gotta let loose and have fun--cartoons or St Patty's Day. Whatever helps.
I learned something helpful from Farrakhan when I went public about Cash Money ripping me off in 98. He told me to tell everyone they were threatening me, not so that if something did happen folks would look right at them, but so that they'd KNOW that if something happened they'd be the first suspects. It gave them incentive to keep me from being hurt. Farrakhan figures the US gov has made moves to KEEP him alive when others may have tried to silence him just because he's been so vocal against them. Not a bad tactic."

You know how I can tell all of these people are intelligent...? Compare the sentence spacing between Rhonda/myself and everyone else. In the corporate world...I got told time and time again that double spaces after a sentence is a waste of time and wrong. I'm noticing as I copy and paste their email excerpts that each of them do that in their emails. From this point forward, I'm going to train myself to do it the way I always fucking knew was right...

The Boy Who Cried Force Placed Insurance - Part 3.1 - Legislational Rage Therapy

To the defense of my ego...this, like most the others, was actually taken years before this story's timeline...I look much better now...You wouldn't recognize me except for the eyes...and I own a lot of cheap sunglasses in the desert...This was at my BFF's Southern Baptist wedding reception...The pic just happened to fit in the right places at the right time...if you know what I really mean...ladies...hahahaha! ;)

I can already tell this one's going to be a fun one, because that picture is seriously cracking me the fuck up right now. You have no idea how bad I want to write the Saga of Versability. The things I did on that site from this period of time are fucking brilliant. I can't wait to get to the summer when I had my nervous breakdown during a power outage. I hope I have enough material to access it in my head without either figuring out how to order the @Versability Twitter Timeline from the Library of Congress or convincing someone else to do it for me.

I assure you, it exists, as does the timeline of every tweet of every user of the popular website, which has around 400 million registered users by now. I don't mean to sound like Nic Cage here, but that in itself is a recipe for disaster, as I've already started noticing companies and agencies worldwide speaking of "newly adapted survey research methods" while tech giants such as Google, Facebook, and Twitter are the tools that will one day destroy us. Anyway, the next chapter (Rain and Showers) will start soon, however I wanted to jump forward in time for a moment to add a pinch of Tarentino and post a letter to foreshadow many months ahead, and as a matter of fact, hot off the presses in Australia today:

Carolyn R. Matthews
Office of the Attorney General
Re: Brian Penny Interview

Dear Ms. Matthews:

As we have discussed, I represent Brian Penny who voluntarily provided an interview to your office. The witness was represented by Cynthia Johnson and me at the interview, which we understood to be taped, but also a confidential proceeding. Of course, any attempts to contact Mr. Penny must be made through me.

Pursuant to Rule 26 of the Arizona Rules of Civil Procedure, you have disclosed the existence of the interview tape to Bank of America’s counsel, in connection with the Attorney General’s civil action against Bank of America related to loan modification claims.

It must be noted that Penny is under no duty to testify as a fact witness or an expert witness and has not agreed to testify at this point.

Further, much of the interview was unrelated to the subject matter of the loan modification claims at issue in your lawsuit and should not be considered “reasonably calculated to lead to the discovery of admissible evidence.” For much of the interview, Penny discussed acts concerning force-placed insurance, activities of Balboa (formerly owned by BoA but recently sold), and the conduct of Balboa in representing other servicers. To the extent that the interview did not relate to the ongoing civil action, it should not be produced.

I remind you that Penny has suffered serious retaliation from Bank of America in the past and has a claim with the EEOC regarding employment related claims against BoA. Of course, should the release of this information cause further retaliatory acts by BoA, it will be reported to the EEOC and will be actionable against BoA.

To the extent that the taped interview reveals Cynthia Johnson or my impressions, conclusions, opinions or theories related to anticipated or existing litigation by Penny against BoA, it should not be produced.

I object to the release of the tape to BoA before sending us a copy to determine if appropriate redactions were made, and privileged matters protected.

Thank you for your time and attention to this matter. Should you have any questions, please do not hesitate to contact me.

Very truly yours,

Select 2011 Facebook Posts

Looking back with 20/20 hindsight, I can put the pieces together a lot more clearly, but even at the time, I realized I was involved in something unique. Law enforcement officers, government officials, and attorneys have all warned me social media is monitored. I knew it was only a matter of time before the technology started evolving. I figured I may as well document the experience as it happens:

My last day with the bank...The day they tried to get me arrested...

The morning after the Tragedy in Tucson...When I decided to reopen my Facebook page to the public so they could not compare me to him...

The day I attended the Def Jam Signing Party for Judge Da Boss as one of his VIP Guests...

Two days prior to the leak with Anonymous...when I realized I have to remain a separate figure from them in order to complete my goals...

Two days after the leak...while growing tired of the repeated personal attacks from both the bank and several members of the mainstream media.

The first time I ever broke a labor law...

March 2011 - By cashing out several retirement funds and successfully securing unemployment insurance through the state for 6 months by proving to them I quit in order to escape unreasonably harsh working conditions within the bank, I was able to afford a comfortable life and wait out the rest of the year financially secure and comfortable without a steady income. I finally had enough plans in place and decided it was time to take action. Although few people other than myself understood the impact of what I had done, popular media personality Cenk Uygar predicted "we might have begun to win the war" when he connected my Empire State Rebellion collaboration with Anonymous to Wikileaks and the Wisconsin Protests (as the "Web" in his WWW segment on MSNBC via The Young Turks)

as the new model on fighting back against the establishment. Alyona Minkovski (through her current affairs television program, The Alyona Show via RT) described my leak from the most fair standpoint I found over the thousands of reports throughout the media. By the end of these two videos, I knew that at least somebody out there who could make a difference understood what I was trying to say. I just didn't feel it was enough yet. If you can't understand why you don't remember any of this happening, read the BREAKING NEWS scrolling across the Alyona clip. My entire life was in chaos, but the major media outlets were busy reporting on natural disasters. I wasn't as flashy.

I was just some broke guy working with some people hiding in shadows and ultimately standing alone in the desert. AnonOps moved on to cover other news items, but the Anon and I still spoke behind closed doors:

We were still making progress though...you can see it more clearly over the long run...

Take a look at BAC's stock from the time I began my search for Anonymous until today.

Thanks to the media coverage, I had several roads open for me. I came into contact with Lisa Epstein, a foreclosure activist in Florida, who had been fighting the banks for years in the courts and city halls of Florida. Lisa also runs a website called foreclosurehamlet.org, in which she provides a safe and private place for attorneys and activists nationwide to discuss foreclosure defense strategies. Lisa and I developed a working relationship and friendship over time, which leads to a later move to Florida.

At the same time, I received some much needed guidance by Wendy Day, who is a pro when it comes to fighting the system. She made a career out of helping artists regain control of the business surrounding the music they make. Aside from leading me in the direction of Gary Webb's famed Iran Contra scandal of the 1980's for comfort, she provided sort of a bouncing board of ideas so I didn't feel so insane with what I was doing and how I was affecting the world.

At the same time, someone hiding behind an uncrackable email delivery system had been training me in setting up anonymous browsing, VPN's, pass through servers, PGP/GPG encryption, etc.

April was going to be a big month. April was when I started meeting with regulators. I spent the rest of the month of March training while establishing contacts within the media, such as with Jenny Churchill, the producer of The Alyona Show on RT networks. I had planted all of the seeds for my personal American Spring, and it was time to make it rain legislation down upon the banks like nobody had ever seen before...because everyone had seriously underestimated me...and I had plenty of tricks left up my sleeves...Next month was when I upped the stakes...

Hi Janel,

The below is one of the emails I provided to Rhonda where I gave detailed statistics relating to my What goals and lived the Bank of America values by attempting to work with her for a resolution. I believe the manager reviews of the PDP's should be done by now, so I'd like you to let me know if my PDP rankings match the statistics I was able to provide below, (including the sources, and my computer at work has all of the detailed information as to where I obtained this).

Whether or not my PDP matches the detailed statistics I provided below, I would like an explanation (as also requested from my manager below) as to what specific statistics were used to determine my ranking. I will forward you a few more emails that I have on me.

Can you please let me know if it is in any way inappropriate for me to access the VPN network utilizing my NBK on a My Work associate's laptop to forward you any emails I have there? I didn't send anything to my home email address that contained any proprietary or NPPI information, so what I can access from home is only general enough to provide an outline of the events that transpired during my tenure in that department. I never had any intention of having to sever ties with the company I dedicated the last 5 years of my life to, so I want to ensure I follow every step the company recommends exactly as communicated to me. I truly want you to know that I am still a dedicated employee who needed a way out of a very bad position I can prove existed.

I would also like to confirm with you once again your statement that I will continue being paid through 1/5/11 with no further interaction needed from me, and that you will inform me of my rehire eligibility. I appreciate all of the advice and assistance you have provided!

Thanks,

Hi Rhonda,

You have recently expressed concerns on multiple occasions (both to me and to several members of your staff) about how long it is taking me to complete my tasks.

I have gathered information from the associate/managers performing my job duties in my absence via email and MOC and compared the results to historical Production logs and ABC reporting (they are very similar). I then took this information and compared it to the averages I have been reporting to you consistently since beginning this position. The below chart shows how long it should take to perform each task (except Illogical Conditions) based on this information.

Each of these tasks is taking approximately the same amount of time for me as it was taking the previous associate of the same level, with the exception of SS Tracking, which takes me an average of 1.25 hrs per day compared to 2.00 hrs from members of Peggy’s management staff. The below chart for Illogical Conditions imports is based on the volume of imported reports multiplied by .107142857 hours per report (again based on ABC Reporting, Production Logs, and input from Scott Willeford/Brian Fierros about how long they felt it took them:

I am also working in systems I have never used before (CCS TSO), or haven’t used in 1-2 years (CCS, Access, Passport, SQL) based on my job duties during that timeframe. Also, in many cases (Special Services Offshore reporting 11/22-11/26, SS reporting 12/13-12/14, RCBAP import 12/13), my job duties were not performed in my absence, despite me providing detailed instructions on how to complete them, providing training (initial & recursive) to the responsible parties, and sending out several reminders. Despite these obstacles, I have consistently succeeded in providing accurate and timely results.

I would be more than happy to research how long it has historically taken a single associate to review and correct a single P&P so that you can accurately track that as well if you would like, although there must be an issue with the way I’m interpreting the production logs, ABC reports, etc. The results match each other regardless of source. They also either match what I’ve been doing/reporting, or I am performing the tasks much quicker than my predecessors/replacements. I’m unable to see where it is you drew your conclusion. Do the statistics you gathered not match with the statistics I found utilizing the tools available to me as an associate? Can you send me a copy of these statistics and walk me through how to correctly analyze them so I understand where it is that I’m falling short of expectations?

I do not mean to sound in any way confrontational, but I find it a little unsettling that I have not only been excluded from the monthly and quarterly departmental Pay for Performance plan since August, but I am told I am not performing my duties quickly enough without being given any specifics, which is leading me to fear that my annual PDP results (and Pay for Performance because of it) will reflect this erroneous belief as well. I do not wish to be negatively impacted any further without understanding where it is coming from.

I am quite interested in learning what supporting evidence led you to the conclusion that I am not meeting any expectations in my delivery of results as I have thus far not been provided with any specifics in my coaching, which as I understand, you require your management staff to give to other associates with similar job titles.

We can discuss tomorrow during my review, or in a separate meeting at another time if you would prefer. I have marked my OH sheet with the time it took for me to gather and analyze these numbers along with drafting this email. Please let me know if you need anything else.

Thanks,

Brian Penny
